Service Provider: Pool Service by Jeff ("Company", "we", "us", or "our")
1. Acceptance of Terms
By accessing poolservicebyjeff.net or hiring Pool Service by Jeff for maintenance, repairs, water testing, cleaning, or seasonal openings/closings ("Services"), you ("Client", "Customer", or "User") agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use this Website or schedule Services with us.
2. Services Offered
Pool Service by Jeff provides pool maintenance, chemical treatment, equipment inspection, and seasonal care. Specific service tiers, maintenance schedules, and included tasks (e.g., skimming, vacuuming, brushing, chemical balancing, filter backwashing) will be specified in your individualized service estimate, work order, or service agreement.
3. Property Access and Safety Requirements
To ensure prompt and safe completion of Services, the Client agrees to:
Provide Unobstructed Access: Ensure pool gates, screen enclosures, and access pathways are unlocked and free of debris or obstacles on scheduled service days.
Pet Restraint: Secure all dogs and other pets indoors or away from the pool area during service visits. Pool Service by Jeff is not liable for pets that escape open gates while technicians are entering or exiting with equipment.
Equipment Access: Maintain clear, safe access to the pump, filter, heater, electrical panels, and water supply.
Water Level: Keep the pool water filled to the midpoint of the skimmer line. Operating pool equipment with insufficient water levels can cause severe pump failure, for which the Company is not responsible.
4. Billing, Rates, and Payment Terms
Recurring Maintenance: Regular maintenance plans are billed monthly in advance or immediately following completed cycles, as specified in your agreement.
Specialty Chemicals & Extra Work: Algae cleanups, acid washes, phosphate treatments, filter cartridge replacements, or repair parts outside regular maintenance agreements will be billed separately upon prior notice or authorization.
Late Payments: Invoices unpaid after 15 days from the invoice date may accrue a late fee of 1.5% per month (or the maximum allowed by law) and may result in a temporary suspension of Services.
Card on File: Recurring plans may require an active credit or debit card on file authorized for automated monthly billing.
5. Cancellations, Rescheduling, and Inclement Weather
Customer Cancellations: Routine service visits cancelled with less than 24 hours’ notice may be subject to a trip fee.
Weather Policy: In the event of severe weather, active lightning, heavy freezes, or tropical storms, regular service will be modified. Technicians will complete chemical testing and balancing if safe, but physical vacuuming and netting may be rescheduled or deferred until the following scheduled visit. Service fees remain consistent unless service is entirely cancelled by the Company.
6. Chemical Balancing, Water Quality, and Staining
Swimmer Safety: Clients agree to adhere strictly to all chemical wait times communicated by technicians (e.g., waiting 2–4 hours after standard shock treatments or balancing chemicals before swimming).
Pre-Existing Surface Issues: Pool Service by Jeff is not responsible for pre-existing plaster discoloration, calcium scaling, etched finishes, vinyl liner fading/wrinkling, or fiberglass degradation caused by long-term chemical imbalance, age, or ground settling prior to service commencement.
Organic Debris: Heavy browning or surface staining caused by organic matter (acorns, pine needles, leaves) left in the pool between scheduled visits remains the homeowner’s responsibility.
7. Equipment, Plumbing, and Structural Disclaimer
Technicians inspect equipment solely for routine operational integrity. Pool Service by Jeff does not warrant that equipment will not fail due to age, wear, electrical surges, freeze damage, or manufacturing defects.
The Company is not responsible for underground leaks, deteriorated plumbing unions, brittle PVC pipes, degraded skimmer throats, or structural cracking not directly caused by our gross negligence.

9. Limitation of Liability
To the maximum extent permitted by law:
Pool Service by Jeff’s total aggregate liability arising out of any claim, service failure, or website dispute shall not exceed the total fees paid by the Client for the specific service visit or monthly billing period at issue.
Under no circumstances shall the Company be liable for indirect, incidental, special, or consequential damages (including lost property value or loss of pool use).
10. Termination of Service
Either party may terminate ongoing service agreements with 30 days’ written notice (email acceptable). All outstanding balances for completed visits or installed parts must be settled immediately upon termination.
11. Governing Law and Dispute Resolution
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict of law principles. Any dispute or claim arising out of these terms shall be resolved in the appropriate court located within the service jurisdiction.
